These terms are a contract between you and DVM Technologies Ltd, the company that operates dvmkit. They are written to be read, not to be impressive. If something here is unclear, ask us before you rely on your own reading of it.
In these terms, "we", "us" and "our" mean DVM Technologies Ltd, and "you" means the person or organisation using dvmkit. A DVM, short for Digital Vending Machine, is an HTTPS service you pay per call, with no account and no API key. A "builder" is whoever runs a DVM.
1. How dvmkit works
Most DVMs are built and run by independent builders, not by us. A builder sets their DVM's price, runs it, and is responsible for it. Many builders host their DVMs on our platform; others run them on their own infrastructure. We also run a few DVMs ourselves: cast, narrate, scrape, scribe and discover.
dvmkit is what sits between you and those DVMs: the website and documentation, the listings and search that help you find DVMs, and the platform that hosts builders' DVMs and passes your requests to them.
How to tell who runs a DVM. A DVM we run has an address made of its name alone, such as narrate.dvmkit.ai. A builder's DVM hosted on our platform puts the builder's handle before its name, as in alice--translate.dvmkit.ai. A DVM hosted anywhere else has an address of its own. A builder's DVM must say who runs it and how to contact them. Finding a DVM through our listings or search does not mean we run it or vouch for it.
2. What these terms cover
These terms cover:
- the website, at
dvmkit.comanddvmkit.ai, including the documentation, the builder waitlist, and the listings and search that help you find DVMs; - your use of our platform to reach any DVM we host, whoever runs it;
- the DVMs we run ourselves, which section 7 covers in more detail.
By using any of them, you agree to these terms. There is nothing to sign and nothing to register.
A builder's DVM is between you and the builder. When you use a DVM that a builder runs, your agreement for that job is with the builder. They set the price, do the work and are responsible for it, under any terms of their own. We are not a party to that agreement, even when we host the DVM. These terms still apply to how you use our platform to reach it, and you can report a DVM to us at support@dvmkit.com.
The software. The dvm command-line tool is distributed under the Apache License 2.0. That licence, and not these terms, governs what you may do with the code itself, including running, modifying and redistributing it. Nothing here adds a condition to it or takes anything away from it. The tool can call any DVM, including ones that have nothing to do with us, and these terms apply only to what you do with dvmkit.
Publishing your own DVM. Building, hosting and publishing a DVM on our platform is covered by the builder terms and the data processing agreement. Builder accounts are invite-only during the beta. If you hold one, these terms still apply to your use of the website.
3. Who can use dvmkit
You must be 18 or over. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it, and "you" means that organisation.
dvmkit is designed to be driven by software agents acting for you. Anything your agent does with your keys and your money, within the budgets you set for it, is treated as done by you. Setting sensible budgets is your responsibility, and the budgets documentation explains the controls available.
Sanctions. You confirm that you are not located in, or ordinarily resident in, Iran, North Korea, Cuba, Russia, Belarus, or the Crimea, Sevastopol, Donetsk, or Luhansk regions of Ukraine, and that you are not named on a UK, EU, US, or UN sanctions list. We refuse requests that appear to come from those regions, judged by the location of the IP address they come from. This applies on the website, except our legal pages, on our platform, and at every DVM we host, and it covers payments and reclaims of prepaid balances as well as jobs. The check can be wrong, and it does not change what you confirm here. If you think it has refused you in error, email support@dvmkit.com. We may also refuse or suspend service, payments, or refunds to anyone where sanctions law requires it.
4. Paying for a job
You pay the DVM's operator directly. On a builder's DVM you pay the builder, and on one of ours you pay us. Payments to builders never pass through us, and we never control them.
You are quoted before you are charged. A DVM quotes each paid job before it runs, in the currency its operator prices in. Your agent sees the price before committing and pays either on your approval or automatically inside the limits you set.
How you can pay. Payments can be made with Cashu ecash, USDC on Base, or USDC on Tempo, and prepaid balances can be topped up over Lightning. Each DVM's operator decides which of these it accepts. None of them is the default: your agent chooses among the ones a DVM accepts, within the limits you set. The rails differ in what they make public, which the privacy documentation covers honestly.
Prepaid credit. You can fund a balance at a DVM and draw jobs from it. The balance is yours, and the DVM's operator owes it to you. It is spendable only at the DVM you funded, and only by the key that funded it. A balance that expires stops being spendable but does not stop being yours: you can still reclaim it with dvm credit drain. Sending a Bitcoin balance back costs a small fixed amount, which comes off what you receive. A Bitcoin balance too small to cover that is not paid out: it stays where it is, and you can reclaim it once a top-up takes it past that amount.
If a DVM we host closes. If a DVM we host is suspended or withdrawn while you hold a balance at it, you can still reclaim that balance for at least 30 days, unless we refuse the reclaim under section 3 or sanctions law requires the balance to be held. Our builder terms require it, and our platform keeps the reclaim route open and will not delete the DVM before then. For a DVM hosted anywhere else, reclaiming depends on whoever runs it.
A failed job is not charged. A charge is a hold placed when a job is accepted and settled only when it completes. If the job fails, is cancelled, or is reaped after the worker running it dies, the hold is released. The software DVMs are built with works this way, and our builder terms forbid builders to work around it. Where the released money lands depends on whether the DVM knows who you are, and the payments documentation sets out each case.
Payments are final. Every rail settles finally and cannot be reversed. Whether a builder refunds a completed job is up to the builder. Section 7 covers refunds for the DVMs we run.
Currency risk is yours. The assets you pay with can change in value. We do not give financial, investment or tax advice, and nothing on the site is such advice.
5. Acceptable use
Do not use dvmkit, or any DVM you reach through it:
- to do anything unlawful, or to produce, store or distribute unlawful content. This includes child sexual abuse material, content that sexualises minors, terrorist content, and material that incites violence;
- to infringe anyone's intellectual property, privacy or other rights;
- to fetch, copy or process content you do not have the right to fetch, copy or process. If you ask a DVM to retrieve a page, you are confirming you are entitled to retrieve it, and you are responsible for complying with that site's terms and access controls;
- to synthesise a real person's voice or likeness without their consent, to make someone appear to say something they did not say, or to impersonate any person or organisation;
- to harass, defame, threaten or endanger anyone;
- to distribute malware, or to probe, scan or attack our systems, the DVMs we host, or anyone else's systems. Genuine security research is welcome under our security contact, and that is the route to use;
- to obtain a service without paying for it, including by exploiting a flaw in a payment rail, a pricing surface or a credit ledger. If you find such a flaw, report it rather than using it;
- to place load that degrades dvmkit for other people, or to circumvent a rate limit, a budget control or a suspension.
We may refuse a request, block a key, suspend access or remove content if we reasonably believe any of the above applies, or if we are required to by law. Where we can do so safely and lawfully, we will tell you why. A builder may have rules of their own for their DVM.
6. Your content
What you send stays yours. You keep all rights in the inputs you send to any DVM.
On a builder's DVM, what happens to your inputs and to the output is between you and the builder, and we claim no rights in either. When we host a builder's DVM, we handle its job data only to host it for them, as our privacy policy explains.
7. The DVMs we run
When you use cast, narrate, scrape, scribe or discover, we are the DVM's operator, and this section applies in addition to the rest of these terms.
Price and payment. They price in US dollars, and you pay us. Prices are stated exclusive of any value added tax or similar tax that we are required to charge. Where we must charge it, we will show it before you pay.
Failed jobs and refunds. When one of our DVMs that charges for work releases a hold, the money lands on your own balance and can be drained back out. Once a job has completed, the payment for it is not refundable, except where the law requires otherwise or where we have made a mistake. If you think we have charged you for work you did not receive, contact us and we will look into it. If we cannot pay a reclaim out through the rail it arrived on, we will tell you why and what to do instead.
Your inputs. You grant us a licence to host, process and transmit your inputs for the sole purposes of running your job, keeping the service secure, and complying with our legal obligations. That licence lasts only as long as we need it for those purposes.
What comes back. As between you and us, we claim no ownership of the output of a job. You are free to use it, subject to these terms and to any rights other people hold in the material it was derived from. Do not resell or redistribute it in a way that presents it as your own service without adding anything to it.
Outputs can be wrong. Several of our DVMs use third-party AI models. Output may be inaccurate, incomplete, offensive or unsuitable for your purpose, and similar output may be produced for other people. It is not a substitute for professional advice. Check anything you intend to rely on. The privacy policy sets out which providers receive job content.
Content you store with us. cast stores audio and images you upload so it can serve them. You are responsible for holding the rights to what you upload. You can delete it, and we may delete it if you stop paying for the DVM or if it breaches section 5.
Withdrawing one of our DVMs. We may withdraw any of our DVMs. We will try to give reasonable notice before withdrawing one that holds prepaid balances or stored content, and to give you a window to reclaim them, but we cannot commit to that in every circumstance.
8. dvmkit is in beta
dvmkit is in beta. It changes often. We may add, change, suspend or withdraw any part of it at any time and without notice, including the platform, the listings and the DVMs we run. We do not promise any level of availability, response time or uptime, and there is no service level agreement. A builder's DVM is available for as long as its builder keeps it running.
9. Suspension and ending this agreement
You can stop using dvmkit at any time. There is nothing to cancel.
We may suspend or end your access to our platform and to the DVMs we run if you breach these terms, if we are required to by law, or if continuing would expose us or other people to material risk.
If we end your access, you can still reclaim any prepaid balance you hold at a DVM we run, unless we are legally prevented from paying it out, we refuse the reclaim under section 3, or the balance is the proceeds of fraud or of a breach of section 5.
Sections 4 (as to payments already made), 6, 7, 10, 11, 12 and 14 survive the end of this agreement.
10. Security reports
If you find a vulnerability in dvmkit, email security@dvmkit.com. Report it before you act on it. We will not pursue legal action over good-faith research that stays within the scope of a report, does not access other people's data, does not degrade the service, and gives us a reasonable opportunity to fix the issue before disclosure. A vulnerability in a builder's DVM is for its builder to fix, but you can report it to us as well, and we will pass it on.
11. Disclaimers and our liability to you
dvmkit is provided "as is" and "as available". To the fullest extent the law allows, we exclude all implied warranties, including any implied term that it will be uninterrupted, error-free, secure, or fit for a particular purpose.
We do not run builders' DVMs and are not responsible for them: for whether they are available, what they produce, what they charge, or how they handle your data or your money. Our responsibility for a builder's DVM is limited to our own obligations in these terms, such as keeping the reclaim route open under section 4.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, nothing here affects your statutory rights.
Subject to that, we are not liable for:
- loss of profit, revenue, business, goodwill, anticipated savings or opportunity;
- loss or corruption of data;
- any loss arising from the value of a digital asset changing;
- any loss arising from a third-party service we depend on failing, including a payment rail, a mint, a blockchain, a model provider or a hosting provider;
- any indirect or consequential loss.
Subject to the paragraph on liability we cannot exclude, our total liability to you for all claims connected with these terms is limited to the greater of £100 and the total amount you paid us in the 12 months before the claim arose. Payments you made to builders do not count towards that amount.
If you are using dvmkit in the course of a business, you will indemnify us against claims, losses and reasonable costs arising from your use of dvmkit in breach of these terms. This does not apply to consumers.
12. If you are a consumer
These rights apply to the DVMs we run and to anything else you buy from us, in addition to everything above. When you use a builder's DVM, the builder is the trader, and your consumer rights for that job are against them.
You normally have 14 days to cancel a contract for digital services bought online. Because a job runs and completes as soon as you pay for it, by submitting a paid job to one of our DVMs you are asking us to begin performance immediately and acknowledging that you lose the right to cancel once the job has completed. Your right to cancel a job that has not yet run is unaffected, and so are your statutory rights if the service is not carried out with reasonable care and skill.
If you have a complaint, contact us first at support@dvmkit.com. If we cannot resolve it, you can bring proceedings in the courts of the country you live in.
13. Changes to these terms
We may change these terms. The current version is always on this page, with the date it was last updated at the top. If a change materially affects your rights, we will give reasonable notice on the site before it takes effect. Continuing to use dvmkit after a change takes effect means you accept the new terms.
14. General
These terms are the entire agreement between us about dvmkit, and they replace anything said before.
If a court finds any part unenforceable, the rest continues to apply.
If we do not enforce a right straight away, we have not given it up.
You may not transfer your rights under these terms without our consent. We may transfer ours to a company that takes over our business, provided your rights are not reduced.
Nobody other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK or in the EU, you keep the protection of the mandatory laws of where you live, and you can bring proceedings there.
